TERMS AND CONDITONS OF BREEDING CONTRACT
1. Stud Fee is due and payable when foal stands and nurses. Mare owner will be billed approximately eleven months after mares last breeding date. Any amount owed thirty (30) days after due date, will be subject to a service charge of 1.5% per month until such time as payment is received in full, including all service charges. Breeder’s certificate will be issued when stud fee and all other fees are paid in full.
2. A $250.00 non-refundable booking fee is required to enter into this contract. Booking fee will be deducted from stud fee.
3. Stallion owner reserves the right to set stud fee, which may be higher when breeding certificate is requested for foals whose dams were bred more then 13 months prior to request.
4. Stud fee must be paid by mare owner, before mare changes ownership or is consigned to a sale.
5. Any unpaid fees owed to Broken Arrow Paints & Quarter Horses (BAP) will be billed with a monthly interest rate of 1.5%. Breeding certificates will not be issued until all fees are paid in full.
6. In the event the above mare fails to produce a live foal, we require written verification from a licensed veterinarian stating so, before mare owner is relinquished from this contract. If mare owner wishes to rebreed mare, another contract must be requested and ½ of the normal booking fee will be required with new contract. Booking fee will be carried over only to the following breeding season.
7. Mare owner may transfer breeding contract to a substitute mare if the above-mentioned mare does not become pregnant within two breeding cycles. This transfer may only occur with written consent from the stallion owner.
8. Mares over 18 years of age will not be accepted, unless given prior approval by stallion owner.
9. By signing this contract, mare owner certifies that he/she is sole owner of above-mentioned mare or has authority to enter into this contract on behalf of the owner.
10. A photocopy of mare’s papers must be furnished with this contract.
11. Only one breeder’s certificate will be issued per paid stud fee.
12. It is agreed that neither stallion owner and or BAPH, its agents or employees, not the farm where the mare is located, or its agents or employees, will be held liable for death, sickness, injury, or accident to the mare or foal and that further the mare owner is not liable for death, sickness, or injury, or accident to the stallion. The mare owner specifically assents to such condition and waives all claims for damages resulting from such injury, death or disability.
