2007 Breeding Contract

This Certifies___________________, here in referred to as mare owner, has engaged one service to
________________ AQHA #______________APHA#__________________ for the 2007 breeding season.
Mare information:  APHA, AQHA, JC reg # ________________ or grade.  Reg. Name_______________

1. A non-refundable booking fee of $250.00 is payable with this contract.  A final payment of $____ when the mare leaves the breeding farm.
2. A copy of registration papers shall accompany this contract, or with delivery of mare.
3. The mare owner agrees to allow the stallion handler to have a qualified Veterinarian check the mare for normal breeding conditions, and to perform other such services the stallion handler deems necessary for the proper treatment and protection of the mare and foal at its side.  This is to be at the mare owners expense and will be billed and due upon billing.
4. The mare owner agrees that each mare offered for breeding shall be halter broke and manageable, in sound breeding condition, and free from infection or disease.  Any mare certified by the attending veterinarian not to be in his opinion in sound breeding condition shall not be bred.  Mare owner may substitute another mare within that breeding season.  Mares must be current on vaccinations, and must have negative culture within 30 days of breeding.
5. The breeder agrees to diligently try to settle the above mare and has sole discretion of determining the best method of breeding.  If the mare doesn't settle, the breeder shall be held harmless.
6. Live foal guarantee.  Means the foal is viable for 72 hours after foaling.  It is understood that if the mare does not carry to term or the foal dies within 72 hours, a return season will be guaranteed the following year if proper notification is given.  Proper notification is written certification by a licensed Veterinarian sent to the stallion owner within two weeks from the time the mare aborts of produces a nonviable foal.  Mare owner certifies that such abortion or death did not result from any act or omission of the owner subsequent to the mare leaving the breeding facility.
7. The breeding season starts Feb. 15th and ends July 15th of the year covered in this contract.
8. Should the above-mentioned stallion die, or become unfit for service, or sold, one of the other stallions can be substituted, the stallion to be the mare owner's choice.  There are no refunds.  If the above-mentioned mare should die or become unfit for breeding, another mare may be substituted within a year.
9. A breeder’s certificate will be issued to the mare owner after all expenses have been paid in full and upon notification of the birth of the foal.
10. Waiver of Liability: it is understood that the stallion owner, stallion handler, Broken Arrow Paints, employees, veterinarians, and guests, shall not be liable for any injury, escape, disability, or death of any horse on its premises.  The above mentioned mare owner will not be liable or responsible for any damage, injury, or death to the breeding farm's stallion, employees, veterinarians, or other animals on the premises, whether or not caused by his/her horse.
11. Non-assignment:  This contract cannot be assigned or transferred by mare owner.  There shall be no right of return to stallion if mare is sold or otherwise changes ownership after being bred by the stallion owner it is a binding contract.
12. When this contract is signed by both parties and accompanied with the booking fee to the stallion owner it is a binding contract.
13. Mare care will be $7.00 a day dry mares, $8.00 a day wet mares.
14. In the case of a lethal white foal, the stallion will give a free return breeding as listed in the live foal guarantee; however there must be a substitute mare, the same mare will not be bred back.
15. For shipped semen, see additional addendum, which must be filled out and returned.
